Can the President Kill You?

Can the president kill an American simply because the person is dangerous and his arrest would be impractical? Can the president be judge, jury and executioner of an American in a foreign country because he believes that would keep America safe? Can Congress authorize the president to do this?
Earlier this week, U.S. Attorney General Eric Holder attempted to justify presidential killing in a speech at Northwestern University law school. In it, he recognized the requirement of the Fifth Amendment for due process. He argued that the president may substitute the traditionally understood due process – a public jury trial – with the president’s own novel version of it; that would be a secret deliberation about killing. Without mentioning the name of the American the president recently ordered killed, Holder suggested that the president’s careful consideration of the case of New Mexico-born Anwar al-Awlaki constituted a substituted form of due process.
Holder argued that the act of reviewing al-Awlaki’s alleged crimes, what he was doing in Yemen and the imminent danger he posed provided al-Awlaki with a substituted form of due process. He did not mention how this substitution applied to al-Awlaki’s 16-year-old son and a family friend, who were also executed by CIA drones. And he did not address the utter absence of any support in the Constitution or Supreme Court case law for his novel theory. (more…)

1,500 voters turned away from caucuses in Washington state

A stunning 1,500 voters were told to go home when they went to the pooled Benton County caucuses at the Three Rivers Convention Center in Kennewick, Washington today.

The local GOP claimed that the convention center reached capacity, adding that they expected around 2,000 people to show up when in actuality around 3,000 attended.

Some of those individuals who thought they would be able to exercise their right to vote today arrived at 9 AM, just to see that the hallways of the convention center were already bursting at the seams with local voters.

Potential voters were told that they could not enter the caucus rooms, leading to some quite justified outrage amongst those who attended and were prevented from voting.

Obama Sets NDAA Detention Guidelines

Students of history may recall the year 49 B.C. Early in that momentous year, a popular soldier-statesman crossed the Rubicon River, thus effectively declaring war on the citizens on the Republic whose acclaim had exalted him to the pinnacle of authority and strength. The details of the story are recounted by the historian Suetonius. Suetonius writes that upon approaching the banks of that historic boundary, Julius Caesar stood before his legion of faithful soldiers and uttered the now-famous phrase: alea iacta est ("the die has been cast"). With those three words, Caesar signaled the end of the Roman Republic. The rule of law soon was supplanted by the rule of one ambitious (audacious?) man.

On Thursday, March 1, the die has been cast again as the American Republic entered the post-NDAA era. On March 1, the major provisions of that unconstitutional measure went into legal effect. Then, with another stroke of his pen, President Barack Obama implemented a set of regulations establishing the policies for implementing the immense powers granted him by the National Defense Authorization Act. Thus, he, and we, crossed into uncharted territory.

The media have portrayed these directives as a move by President Obama proving the strength and sincerity of his resolve to never deploy the military to detain American citizens without a trial. A closer look reveals that the media blowing of the President’s trumpet is mostly sound and fury, signifying nothing.

Nearly two months have passed since the President signed the NDAA into law. On December 31, 2011, with the portentous affixing of his signature to that law passed overwhelming by the Congress, the writ of habeas corpus — a civil right so fundamental to Anglo-American common law history that it predates the Magna Carta — became voidable upon the command of the President of the United States. The Sixth Amendment right to counsel — also revocable at his will.

Eric Holder has gone all-in supporting race-based hiring preferences and race-based benefits. Given that the majority of Americans despise this rot, surely the presidential candidates will pounce.
In a little noticed interview at the “World Leaders Forum,” Holder makes statements that should be the subject of a direct mail piece in Pennsylvania, Ohio, Wisconsin, and Virginia:

Holder expressed support for affirmative action, saying that he “can’t actually imagine a time in which the need for more diversity would ever cease.”

“Affirmative action has been an issue since segregation practices,” Holder said. “The question is not when does it end, but when does it begin. … When do people of color truly get the benefits to which they are entitled?”

Let me repeat: When do people of color truly get the benefits to which they are entitled? Again, the benefits to which they are entitled.

The election next November will not be just another election, and the stakes add up to far more than the sum of the individual issues. Moreover, if reelected and facing no future election, whatever political constraints may have limited how far Obama would push his radical agenda will be gone.

He would have the closest thing to a blank check. Nothing could stop him but impeachment or a military coup, and both are very unlikely. A genial corrupter is all the more dangerous for being genial.
The four remaining Republican candidates have to be judged, not simply by whether they would make good presidents, but by how well they can cut through Obama’s personal popularity and glib rhetoric, to alert the voters as to the stakes in this year’s election.

Ron Paul? Even those of us who agree with much of his domestic agenda, including getting rid of the Federal Reserve System, cannot believe that his happy-go-lucky attitude toward Iran’s getting a nuclear weapon represents anything other than a grave danger to the whole Western World.

In a major victory for Americans who value liberty and the First Amendment, a Cook County, Illinois judge ruled that the state’s highly controversial eavesdropping law is unconstitutional.

The law made the simple act of recording a police officer without their consent, even during the course of their public duties, a felony offense.

Judge Stanley Sacks declared that the eavesdropping law is unconstitutional on the grounds that it has the potential to criminalize what would otherwise be “wholly innocent conduct.”

I couldn’t agree more, and it’s great to see that there are, in fact, some sane individuals working in the American justice system still.
